The Gauss-Hertz principle is extended by the use of existence conditions (or constraints) to obtain a hierarchy of differential equations which include all classical equations of continuum mechanics (including electrodynamics) and the harmonic oscillator potential as well.

The continuum form of the Gauss-Hertz principle is extended to include the time domain as well as space. The Schrödinger equation and general relativity are derived by this method. The equivalence of the principle is shown to that of the Hamiltonian method where the energy is the expression −[φ∇ 2 φ+A·∇2 A], with φ being the difference between the acceleration potential and potential energy density, andA being the difference between the vector potentials of the acceleration field and the force field. The question addressed here is whether evidence concerning defendants' past criminal records should be introduced at their trials because such evidence reveals their character and thus reveals whether they are the kinds of persons likely to have committed the crimes with which they are currently charged. I strongly caution against the introduction of such evidence for a number of reasons. First, the link between defendants' past criminal records and claims about their standing dispositions to think and act is tenuous, at (...) best. Second, noncharacter, or trace, evidence should have primacy in determining the guilt or innocence of defendants. Third, character evidence will vary in its freshness and specificity. Other things being equal, only relatively fresh and specific character evidence has probative value. Moreover, such evidence will have greater probative value in criminal cases where the issue before the court is whether a crime has been committed than in cases where the issue is whether it was the defendant who committed the crime. Finally, we might be more sanguine about the introduction of fresh and specific character evidence under conditions likely to work against its misuse or misinterpretation. However, the relevant conditions may not often be satisfied in the real world of criminal trials and defendants. (shrink)

Several theoretical perspectives have generated research on grandparental investment, notably socialization and evolutionary psychological perspectives. Using data collected from more than 200 older adults (mean age 67 years), we test three hypotheses derived from socialization and evolutionary perspectives about grandparents’ relationships with and investment in grandchildren. Results indicate that (1) emotional closeness with both children and children-in-law is positively related to reports of emotional closeness with grandchildren; (2) maternal grandmothers invest more in grandchildren than do other grandparents; and (3) grandparents (...) invest more in daughters’ children than in sons’ children. Discussion addresses limitations of self-report methodology in this context and situates the current findings within the body of research indicating the existence of psychological mechanisms designed to guide differential nepotism. We present a detailed process theory of the moment‐by‐moment working‐memory retrievals and associated control structure that subserve sentence comprehension. The theory is derived from the application of independently motivated principles of memory and cognitive skill to the specialized task of sentence parsing. The resulting theory construes sentence processing as a series of skilled associative memory retrievals modulated by similarity‐based interference and fluctuating activation. The cognitive principles are formalized in computational form in the Adaptive Control of Thought–Rational (ACT–R) architecture, and our (...) process model is realized in ACT–R. We present the results of 6 sets of simulations: 5 simulation sets provide quantitative accounts of the effects of length and structural interference on both unambiguous and garden‐path structures. A final simulation set provides a graded taxonomy of double center embeddings ranging from relatively easy to extremely difficult. The explanation of center‐embedding difficulty is a novel one that derives from the model' complete reliance on discriminating retrieval cues in the absence of an explicit representation of serial order information. All fits were obtained with only 1 free scaling parameter fixed across the simulations; all other parameters were ACT–R defaults. The modeling results support the hypothesis that fluctuating activation and similarity‐based interference are the key factors shaping working memory in sentence processing. We contrast the theory and empirical predictions with several related accounts of sentence‐processing complexity. (shrink)

In _Freedom and the End of Reason_, Richard L. Velkley offers an influential interpretation of the central issue of Kant’s philosophy and an evaluation of its position within modern philosophy’s larger history. He persuasively argues that the whole of Kantianism—not merely the Second Critique—focuses on a “critique of practical reason” and is a response to a problem that Kant saw as intrinsic to reason itself: the teleological problem of its goodness. Reconstructing the influence of Rousseau on Kant’s thought, Velkley (...) demonstrates that the relationship between speculative philosophy and practical philosophy in Kant is far more intimate than generally has been perceived. This book grew out of my confusion. If logic is objective how can there be so many logics? Is there one right logic, or many right ones? Is there some underlying unity that connects them? What is the significance of the mathematical theorems about logic which I've learned if they have no connection to our everyday reasoning? The answers I propose revolve around the perception that what one pays attention to in reasoning determines which logic is appropriate. The act of (...) abstracting from our reasoning in our usual language is the stepping stone from reasoned argument to logic. We cannot take this step alone, for we reason together: logic is reasoning which has some objective value. For you to understand my answers, or perhaps better, conjectures, I have retraced my steps: from the concrete to the abstract, from examples, to general theory, to further confirming examples, to reflections on the significance of the work. For more than a decade, American lawyers have bewailed the ethical crisis in their profession, wringing their hands about its bad image. But their response has been limited to spending money on public relations, mandating education, and endlessly revising ethical rules. In this book, Richard Abel will argue that these measures will do little or nothing to solve the problems illustrated by the six disciplinary case studies featured in this book unless the legal monopoly enjoyed by attorneys in the (...) The dominant approach to the analysis of issues in business ethics consists in the articulation and use of a set of mid-level moral principles. This approach is geared to business practitioners who are not interested in the difficult problems of moral and political theory. I argue that this "practitioner model" is philosophically suspect. I show how the theoretical frameworks prominent business ethicists employ are insufficiently developed. I also show how many of their analyses presuppose substantive views about issues of social (...) justice which they rarely defend or acknowledge. Since no neutral position on these issues is available, I argue that the only alternative is to address the problems such issue's raise for the analysis of institutions and the conduct of persons acting under those institutions. I offer suggestions about how we can develop a more philosophically defensible approach to business ethics. (shrink)

This book draws upon philosophical arguments, criminological evidence, and legal literature on prisoners' rights and sentencing to explore the restrictions and deprivations that can be legitimately imposed on serious offenders in the name of punishment.

We propose a framework for including information‐processing bounds in rational analyses. It is an application of bounded optimality (Russell & Subramanian, 1995) to the challenges of developing theories of mechanism and behavior. The framework is based on the idea that behaviors are generated by cognitive mechanisms that are adapted to the structure of not only the environment but also the mind and brain itself. We call the framework computational rationality to emphasize the incorporation of computational mechanism into the definition of (...) rational action. Theories are specified as optimal program problems, defined by an adaptation environment, a bounded machine, and a utility function. Such theories yield different classes of explanation, depending on the extent to which they emphasize adaptation to bounds, and adaptation to some ecology that differs from the immediate local environment. We illustrate this variation with examples from three domains: visual attention in a linguistic task, manual response ordering, and reasoning. We explore the relation of this framework to existing “levels” approaches to explanation, and to other optimality‐based modeling approaches. (shrink)

The purpose of this paper is to examine the distinction between "negative" and "positive" duties. Special attention will be given to certain criticism raised against this distinction by Michael Tooley.

Those found liable for negligently injuring others are required to compensate them, but current practices permit most tort feasors to spread the costs of their liability burdens through the purchase of insurance. Those found guilty of criminal offences, however, are not allowed to shift the burdens of their sentences onto others. Yet the reasons for not allowing criminal offenders to shift such burdens – harm reduction, retribution, and moral education – also appear to retain some force in relation to negligent (...) tort feasors. Arguments for and against limiting the abilities of negligent tort feasors to spread such costs, thus imposing a penalty on them, are discussed. The conclusion reached is that further consideration of such a penalty is warranted. (shrink)

The United States relies on uncompensated family caregivers to provide most of the long-term care required by older adults as they age. But such care comes at a significant financial cost to these caregivers in the form of lower lifetime earnings and diminished Social Security retirement benefits, ineligibility for Medicare coverage of their healthcare costs, and minimal retirement savings. To reduce the impact of uncompensated caregiving on the intergenerational transmission of poverty, this paper discusses three possible mechanisms of compensating family (...) caregivers: public payments, deemed wage credits under Social Security, and income tax incentives. The mere exposure phenomenon (repeated exposure to a stimulus is sufficient to improve attitudes toward that stimulus) is one of the most inspiring phenomena associated with Robert Zajonc’s long and productive career in social psychology. In the first part of this article, Richard Moreland (who was trained by Zajonc in graduate school) describes his own work on exposure and learning, and on the relationships among familiarity, similarity, and attraction in person perception. In the second part, Sascha Topolinski (a recent (...) graduate who never met Zajonc, but found his ideas inspirational) describes his own work concerning embodiment and fluency in the mere exposure effect. A major figure in the European Enlightenment period of Philosophy, his Collected Writings were first published in 1900 constituting 29 volumes. He wrote three major works that are foundational to the development of Western philosophy and the human sciences. Often just referred to as (...) the “Three Critiques” informally, the First, the Second, and the Third. These are respectively: The Critique of Pure Reason focused on issues in logic, The Critique of Practical Reason relating ethical guidelines, and The Critique of Judgment exploring issues of aesthetics. He is most famous for his philosophy of transcendental idealism. This version of idealism argues that in logic statements are analytic or synthetic. He further argues that statements are a priori or a posteriori. Models of rhetoric, phenomenological methodology, and the contemporary Perspectives Model of interpersonal communicology are included as the Kantian legacy in the US. There is a core to the referential/attributive distinction that reveals a propositional ambiguity that is scope-related and rooted in syntax.

This study reexamines the existentialist nature of Walker Percy's fiction, arguing that his debt to Kierkegaard is more substantial than previously acknowledged. Others have noted his employ of Kierkegaardian stages, terminology, and artistic indirection, but they haven't revealed the extent to which his sources lie in Kierkegaard and the action of his novels occurs within the context of a "Kierkegaardian narrative." Prior critics have overstated both the role his protagonist's "searches" and the assistance of others play in their movement to (...) faith. This study rejects the Marcelian reading of Percy's endings and demonstrates that his characters follow a Kierkegaardian path toward faith; they do not move toward faith via the assistance of an other, but subjectively, by despairing of their efforts to find ontological answers in immanent sources and choosing, in the midst of that despair, a paradoxical faith. ;Chapter one pairs Kierkegaardian philosophy with views espoused by Percy in his nonfiction and interviews in order to establish their intellectual affinities: each uses art as a means of responding to the objectifying forces of rationalism and posits a movement toward self which necessitates the embrace of faith after despairing of an aesthetic existence. The second and third chapters provide extended Kierkegaardian readings of The Moviegoer and The Last Gentleman, tracing their sources to his philosophy and demonstrating how each can be read within a Kierkegaardian framework and as a tacit either/or. Percy's protagonists either "come to themselves" by despairing of their own searches and realizing a subjective faith , or they remain in Kierkegaard's aesthetic stage, separated from faith, and thus lost to themselves . Both readings of Percy's novels reveal the ways in which he continually adopts Kierkegaardian categories, images, and details as he works within the larger framework of the paradoxical movement toward faith. The study concludes by emphasizing the Christian character of the narratives of Kierkegaard and Percy and arguing that a strict Kierkegaardian reading of Percy's fiction is more illuminating than the use of multiple existentialist perspectives.
